KICKSTART BREAKFAST 10 YEAR CELEBRATION 2019
TERMS AND CONDITIONS (NEW ZEALAND)

  1. These terms and conditions relate to the KickStart Breakfast 10 Year Celebration competition (“Promotion”). Information on how to enter and prizes forms part of, and entry into the Promotion is deemed to be acceptance of, these terms and conditions.
  2. The promoters of this competition are Fonterra Co-Operative Group Limited, the New Zealand Health Association Limited (trading as Sanitarium) and the New Zealand Government, as the partners of the KickStart Breakfast Programme (the “Promoter”). The “KickStart Breakfast Team” is a team that represents the Promoter and may act on the Promoter’s behalf in relation to the Promotion.
  3. The Promotion commences at 6am Wednesday 6 November and closes at 6pm Friday 15 November 2019 (“Promotional Period”). Entries received before the Promotional Period may be accepted at the Kickstart Breakfast Team’s discretion. Entries received after the Promotional Period will not be accepted.
  4. Conditions of Entry
  5. All entrants to the Promotion must be:
    1. over the age of 18 (or have consent from a parent or guardian);
    2. a New Zealand resident; and
    3. a student at a school that participates in the KickStart Breakfast Programme (“School”).
  6. All entries into the Promotion must be submitted by a representative of a School.
  7. There is no limit on the number of entries per School, although no School can win more than one Prize.
  8. Prizes
  9. Ten prize winners will be drawn.
  10. Each winner will receive a Sunbeam Two Way Blender (RRP NZD$299.99) for their School (“Prize”). The Prizes will be awarded to the Schools that submitted the winning entries.
  11. Use of the Prize will be at the School’s discretion, although the KickStart Breakfast Team suggests that the Prize is used for the School’s KickStart Breakfast club to be enjoyed by those students who attend breakfast club.
  12. How to enter
  13. Schools are invited to have their students create healthy recipes that feature KickStart Breakfast products AnchorTM milk and Sanitarium Weet-BixTM (“Recipes”). Schools may choose to print out the recipe template provided in the KickStart Breakfast Recipe Book however use of this template is not required for an entry to be valid.
  14. To enter, completed Recipes must be scanned and emailed by the School to the KickStart Breakfast Team at [email protected]. Schools are responsible for obtaining and providing any parental/guardian consents required by entrants to the Promotion.
  15. Entries must be received no later than 6pm Friday 15 November 2019. The KickStart Breakfast Team may, at its discretion, accept entries submitted prior to the start of the Promotional Period.
  16. By entering a Recipe in the Promotion the School agrees that the Promoter shall have the right to store and use the Recipes (including any images or letters contained in a Recipe) free of charge for any business or marketing purpose in any media whatsoever. The KickStart Breakfast Team may share Recipes with all employees of the partners of the Promoter, and all suppliers and franchisees of the Promoter (without whom the KickStart Breakfast Programme would not be possible).
  17. In addition to complying with these terms, you must comply with any additional instructions stated on www.kickstartbreakfast.co.nz
  18. All entries are deemed to be received at the time received by the KickStart Breakfast Team via email (along with any required parental/guardian consents), and not at the time of transmission by the School.
  19. Draw and Winner Notification
  20. The prizes will be drawn at random by the KickStart Breakfast Team on Monday 18 November 2019 and the winning Schools will be notified by e-mail on Tuesday November 19 2019. If more than one winning entry is drawn from the same School, only the first winning entry drawn will be deemed valid and the KickStart Breakfast Team will draw further entries until all ten Prizes have been won by different Schools.
  21. The KickStart Breakfast Team’s decisions are final and no correspondence will be entered into.
  22. Winners will also be announced through the KickStart Breakfast Programme newsletter on Tuesday December 3 2019.
  23. Publicity
  24. The winning Schools of any prize agree to co-operate with all reasonable media editorial requests from the Kickstart Breakfast Team or the Promoter relating to the Promotion, including interviewing school staff or children, and allowing photography or videography. Winning Schools are responsible for obtaining any staff and parental consents that may be required to carry out such media editorial requests. Winning Schools permit the School’s name, image and/or any content gathered pursuant to any media editorial requests to appear in connection with the Promotion, the Promoter or the advertising or marketing thereof, in any media whatsoever.
  25. General Terms
  26. The Promoter and the KickStart Breakfast Team reserve the right to change these terms and conditions without prior notice.
  27. Prizes cannot be varied and are not transferable or redeemable for cash.
  28. The Promoter and the KickStart Breakfast Team reserve the right to request any winning School to KickStart Breakfast Programme T: 0800 900 070 E: [email protected] provide proof of participation in the KickStart Breakfast Programme and any other proof required for entry validity. In the event that such proof is not provided by the winning School or is not suitable to the KicKStart Breakfast Team, then that winning School (and applicable entrant) shall forfeit their rights to any prizes.
  29. The Promoter and the KickStart Breakfast Team reserve the right to verify the validity of entries and to disqualify any entry (including a winning entry) which, in the Promoter or KickStart Breakfast Team’s opinion includes objectionable content, profanity or potentially insulting, inflammatory or defamatory statements.
  30. The Promoter and/or the KickStart Breakfast Team may disqualify any entry or individual (including any Prize winner) who tampers with the entry process, submits an entry not in accordance with the terms and conditions, breaches these terms and conditions, or who has, in the opinion of the Promoter, engaged in conduct which is unlawful, improper, fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promoter or Promotion.
  31. The Promoter and the KickStart Breakfast Team assume no responsibility for any problems or technical malfunction of any web site, telephone network or lines, computer systems, servers, providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof.
  32. The Promoter and the KickStart Breakfast Team assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries.
  33. If for any reason the Promotion is not capable of running as planned for reasons including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter or the KickStart Breakfast Team, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its sole discretion to cancel, suspend or modify the Promotion.
  34. The Promoter and the KickStart Breakfast Team take no responsibility for lost, damaged, misdirected, late or illegible entries or any entries that for whatever reason, are not received by the KickStart Breakfast Team or are incomplete.
  35. To the maximum extent permitted by law, the Promoter (and its related companies) and the KickStart Breakfast Team shall not be liable for any loss, damage, or personal injury whatsoever by or to any person in connection with the Promotion or with winning or benefiting from a Prize.
  36. All entries become the property of the Promoter. The Promoter (via the KickStart Breakfast Team) needs to collect personal information from entrants in order to conduct the Promotion – without this personal information the Promoter may not be able to provide you with entry into the Promotion. Unless otherwise authorized by you, your personal information will be held by the Promoter for the purposes of the Promotion and may be shared with partners of the Promoter solely for the purposes of the Promotion.
